Terms of Service

These terms are an agreement between you and FUNTG Limited, a company registered in Hong Kong (“we”, “us”), which operates Coneker. They cover the iPhone and Android apps, the web app at app.coneker.com, and this website. By creating an account or using Coneker, you agree to them. Our Privacy Policy explains how we handle your data and is part of these terms. If you do not agree, please do not use Coneker.

1. Your account

• You must be 16 or older to use Coneker. If you buy anything, you must also be old enough to make a binding purchase where you live, or have a parent’s or guardian’s permission.
• Give accurate sign-in details, and keep your devices, password and passkeys secure. You are responsible for what happens under your account. If you think someone else has access, tell us at support@funtg.com.
• An account is for one person. Do not share it, sell it or create accounts by automated means.
• Coneker is young, and parts of it are offered to testers or by invitation. Features may change, be limited or be withdrawn as it develops.

2. Your content

What you put into Coneker stays yours. This includes notes, recordings, photos, documents and messages. You give us permission to host, copy, process and display it only as needed to provide Coneker to you. That includes sending it to the service providers named in the Privacy Policy, and to the people you choose to share it with. That permission ends when you delete the content or your account, except for the backups and records the Privacy Policy describes.

Keep your own copy of anything important. Export is in Settings. We work hard not to lose data, but we cannot promise we never will.

3. Other people’s information, and recording

Coneker is for keeping track of the people in your life, so most of what you record will be about someone else. You are responsible for having the right to record it. In particular:

• Get consent before you record a conversation wherever the law requires it. In many places everyone being recorded must agree, and recording without consent can be a crime. Follow the law where you are and where they are.
• Only upload business cards, photos, documents and details you are entitled to hold. Use them for your own personal and working relationships.
• You are responsible for complying with the privacy and data-protection laws that apply to what you record. We process that information on your behalf.

4. What you may not do

• Use Coneker to stalk, track, harass, intimidate or covertly monitor anyone. Do not use it to build profiles of people for anyone else’s use.
• Record, upload or share anything you have no right to, or anything unlawful, defamatory or infringing.
• Try to reach another person’s account or data, probe or break our security, or get around usage limits.
• Scrape, copy or resell Coneker, or reverse-engineer it except where the law allows.
• Overload the service, or use it to send spam or malware.
• Use Coneker’s AI features to produce content that is unlawful or intended to deceive.

5. AI features can be wrong

Coneker uses AI models, and they make mistakes. This covers reading your notes and photos, transcribing and translating speech, answering questions, and suggesting insights. It may misread a name, attach something to the wrong person, mishear a word, or state something plausible that is untrue. You review what is extracted before it is saved; please do. Check anything that matters before relying on it.

Nothing Coneker produces is professional advice. That includes legal, medical, financial and investment advice. Information found on the web comes from third parties, and we do not check or stand behind it.

6. Friends, sharing and messages

When you share a record or a meeting with a friend and they accept it, a copy goes into their account and becomes theirs. It stays with them even if you later delete yours. Messages are delivered to the people in the conversation. Share only what you are comfortable handing over, because we cannot control what other users do with it. You can remove a friend at any time, and you can report misuse to us.

7. Free allowance, purchases and subscriptions

• Free allowance. Every account includes an allowance of AI use (measured in tokens) and of recording time. It refills on a schedule shown in the app. We may change the allowance.
• Packs. You can buy AI tokens in packs of 1,000,000, and recording time by the hour. A purchased balance expires three months after your most recent purchase, and any unused balance then lapses.
• Coneker Pro is a monthly subscription. Each month it adds an allowance of 2,000,000 tokens and 30 hours of recording, which does not carry over to the next month. It renews automatically each month until you cancel. On the web, cancel from the Coneker Pro page. The plan then runs to the end of the month you have paid for and does not renew.
• Prices and what each purchase includes are shown before you pay, in your local currency where available. We may change prices. A change to Coneker Pro applies from your next renewal, and we will tell you before it takes effect.
• App Store purchases are made with Apple, under Apple’s terms. Apple handles the billing, renewals and refunds, and you manage or cancel an App Store subscription in your iPhone’s Settings, not in Coneker. Deleting your Coneker account does not cancel an App Store subscription.
• Web purchases are processed by Stripe. Purchases are generally non-refundable once delivered, and a subscription month that has started is not refunded. We will consider a refund if something went wrong, and will always give one where the law requires. If a purchase is refunded or charged back, the tokens, time or plan it gave you are removed.
• Deleting your account cancels a Coneker Pro subscription paid on the web and ends it immediately. Any unused balance is forfeited.

8. Suspension and ending

You can stop using Coneker, and delete your account, at any time. We may suspend or close an account that breaks these terms, puts other people or the service at risk, or that we are required to close by law. Where it is reasonable and lawful, we will tell you first and give you a chance to export your data. We may also discontinue Coneker. If we do, we will give reasonable notice, and refund any subscription period you have paid for but not received.

9. Other services

Coneker connects to services we do not run: Apple and Google sign-in, map apps, app stores, payment processors, and the websites a web search finds. Their own terms apply, and we are not responsible for them.

10. Our software

Coneker, including its apps, design and brand, belongs to us and our licensors. We give you a personal, non-transferable permission to use it under these terms, and that permission ends if your account does.

11. Disclaimers

We work to keep Coneker available, accurate and secure, but it is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will be uninterrupted, error-free or fit for a particular purpose, or that AI output will be accurate. Nothing in these terms limits any rights you have under consumer law that cannot be excluded.

12. Limits on our liability

To the extent the law allows:

• we are not liable for indirect or consequential loss, lost profits, or loss of data you could have kept by exporting it;
• we are not liable for decisions you make based on AI output;
• we are not liable for what other users do with information you share with them;
• our total liability to you for all claims is limited to the greater of the amount you paid us in the 12 months before the claim, or HK$100.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.

13. Your responsibility to us

If someone brings a claim against us because of content you recorded or shared, or because you broke these terms or the law, you will cover our reasonable costs and losses from that claim. This applies, for example, to a recording made without the consent the law required. This does not apply to the extent the claim was caused by our own fault.

14. Changes to these terms

We may update these terms, and will post the new version here with a new effective date. For a material change, we will tell you in the app or by email before it takes effect. If you keep using Coneker after that, the new terms apply. If you do not accept them, you can delete your account.

15. Law and disputes

These terms are governed by the laws of the Hong Kong Special Administrative Region, and its courts have jurisdiction over any dispute. If you are a consumer living elsewhere, you keep the protection of the mandatory laws of where you live, and may bring a claim in your local courts. Please contact us first; most problems can be fixed by talking.

16. General

If part of these terms turns out to be unenforceable, the rest still applies. If we do not enforce a term straight away, we have not waived it. You may not transfer these terms without our consent. We may transfer them to a company that takes over Coneker, and your rights will not be reduced by that. These terms are published in English and Traditional Chinese, and if they differ the English version prevails.
